Judge Ponders Smokable Medical Marijuana

Advocates for medical marijuana are asking a Tallahassee judge to allow patients to smoke their meds.

Orlando attorney John Morgan, who bankrolled the amendment legalizing medical marijuana, says smoking works best for some patients and the state ban on smoking interferes with their care.

"Enough is enough," he said. "Let's stop the politics, let's let these people live their final years with dignity ...That's all she's fighting for."

The suit was filed on behalf of Cathy Jordan, who was diagnosed with Lou Gehrig’s Disease more than 30 years ago.

She told the judge that smoking marijuana is the only reason she's still alive.

Lawyers for the state claim the legislature has the right to limit medical marijuana because smoking is not an efficient delivery system and second-hand smoke is a health hazard.
